If optional medical or emergency information is provided, it may be shared with trusted contacts, caregivers, response coordinators, contact centers, central stations, public safety resources, roadside providers, service providers, or other authorized recipients as reasonably necessary to provide the Services.

16. Parent and Guardian Rights

The FTC Health Breach Notification Rule may apply to certain health apps and similar technologies that maintain individually identifiable health information and are not covered by HIPAA. My Guardian Link should have counsel review whether any optional medical or emergency profile feature triggers additional health-data obligations.

Subject to applicable law and verification, a parent or legal guardian may have the right to:

  • Removal of trusted contact alerts;
  • Disabling of location features;

19. Data Retention for Children and Minors

My Guardian Link retains child and minor information only as long as reasonably necessary for the purposes described in the Privacy Policy, this Policy, and applicable agreements, unless a longer period is required or permitted by law.

My Guardian Link does not sell children’s personal information as a standard business practice.

If any analytics, cookies, SDKs, pixels, advertising tools, or app technologies could be considered a sale, sharing, targeted advertising, or behavioral advertising under applicable law, My Guardian Link will provide required notices, choices, consents, or restrictions.

Violation may result in suspension, termination, disclosure of records, referral to law enforcement, civil liability, administrative penalties, criminal consequences, reimbursement claims, and other remedies.

22. Custody, Family Disputes, and Protective Orders

My Guardian Link is not responsible for resolving custody disputes, guardianship disputes, family disputes, school disputes, caregiver disputes, or disputes between parents or guardians.

A person who creates, manages, or authorizes a child or minor account represents that they have legal authority to do so.

  • Limit access;
  • Disable certain features;
  • Preserve records;
  • Refuse to release information until authority is verified;
