These Terms of Use (“Terms”) govern your access to and use of the My Guardian Link™ website, mobile application, platform, urgent communication tools, trusted contact features, notification services, membership plans, group plans, and related services (collectively, the “Services”).

By creating an account, downloading or using the mobile application, purchasing a membership, joining a group plan, activating an urgent signal, adding trusted contacts, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

These Terms are intended for consumer users of My Guardian Link. Separate agreements may apply to enterprise customers, sponsor groups, referral groups, strategic partners, contact centers, central stations, vendors, or other business relationships.

IMPORTANT EMERGENCY SERVICE LIMITATIONS

  • My Guardian Link is not 911 and is not a police, fire, ambulance, emergency medical, public safety answering point, security, or government emergency service.
  • If you can safely contact 911 or local emergency services directly, you should do so.
  • An alert created in the app does not guarantee that it will be delivered, assigned to an Human Response Coordinator, escalated to public safety, or result in dispatch, rescue, prevention of harm, or any particular outcome.
  • The Services depend on your device, battery, permissions, connectivity, location accuracy, third-party systems, and the availability and discretion of Trusted Contacts, coordinators, service providers, and public safety agencies.

1. DEFINITIONS AND TWO-PART SERVICE STRUCTURE

My Guardian Link consists of two coordinated but distinct components:

  • Mobile Application. The My Guardian Link mobile application provides digital communication and safety tools that allow users to create and manage accounts, enter profile and emergency information, add Trusted Contacts, create alerts, share location information, send and receive messages, and view incident-related information.
  • Live Response Service. The Live Response Service is a human-operated service performed outside the mobile application through an External Response Center. When an eligible incident is assigned, a trained Human Response Coordinator may review available incident information, attempt to contact the user, communicate with Trusted Contacts, coordinate information, contact an appropriate emergency or assistance provider when warranted, and document the response.

Defined Terms

“External Response Center” means the operations environment, separate from the consumer mobile application, through which trained human coordinators receive and manage eligible Live Response assignments.

“Human Response Coordinator” means a trained human operator working through an External Response Center.

“Trusted Contact” means a person designated by a user to receive alerts, messages, location information, or other incident communications.

“Member” means a user who is currently eligible for the Live Response Service under an active membership, sponsor arrangement, enterprise arrangement, or other authorized service plan.

“Free User” means a user who may use available digital application tools but is not currently eligible for assignment to the Live Response Service.

2. MOBILE APPLICATION: DIGITAL COMMUNICATION AND SAFETY TOOLS

The mobile application may provide the following digital tools, subject to device compatibility, permissions, jurisdiction, configuration, and service availability:

  • Create and manage an account and profile;
  • Add and maintain Trusted Contacts and emergency contacts;
  • Add optional personal, medical, disability, caregiver, household, or emergency information;
  • Create supported alerts and enter incident details;
  • Transmit messages, timestamps, device information, and available location information;
  • Share alerts, map links, and location information with Trusted Contacts or other authorized recipients;
  • Receive replies, calls, notifications, and account communications;
  • View user-accessible alert or incident history and related records;
  • Use approved onboarding, training, demonstration, or practice functions; and
  • Manage account, plan, support, and privacy settings.

Nature of the Digital Tools

The mobile application is a communication tool. It does not itself provide police, fire, medical, roadside, security, dispatch, or emergency services. Creating or transmitting an alert through the mobile application does not, by itself, establish that a Live Response assignment has been created or accepted.

3. LIVE RESPONSE SERVICE: HUMAN-OPERATED SERVICE OUTSIDE THE APP

The Live Response Service is designed to provide access to trained human coordinators through an External Response Center. It is separate from the app’s digital tools and is performed by people using external response-center systems and communications channels.

For an eligible incident, an Human Response Coordinator may, depending on the circumstances and available information:

  • Receive and review the Live Response assignment and available incident information;
  • Attempt to contact the user by phone, text, app message, or other available method;
  • Attempt to contact one or more Trusted Contacts;
  • Clarify, relay, and coordinate information among the user, Trusted Contacts, service providers, and public safety resources;
  • Contact an appropriate 911 center, public safety answering point, law enforcement agency, fire department, emergency medical provider, roadside provider, caregiver, or other assistance resource when the coordinator determines that doing so is appropriate and reasonably available;
  • Provide available identity, location, incident, and callback information to the contacted resource; and
  • Create operational notes and documentation regarding the coordinator’s handling of the incident.

Service Availability

The Live Response Service is designed for continuous availability, but no uninterrupted availability is promised. Staffing, communications, service-provider systems, public safety systems, maintenance, outages, extraordinary events, and other factors may delay, limit, or prevent response.

4. FREE USERS AND MEMBERS

Free Users may use the digital application tools made available to them, including supported account, profile, Trusted Contact, alert, messaging, location-sharing, and incident-history functions. A Free User’s alert may communicate with Trusted Contacts or other designated recipients, but it is not eligible for handling by an Human Response Coordinator unless the user is otherwise covered by an active membership or authorized plan.

Members may use the same available digital application tools and, in addition, are eligible for the external, human-operated Live Response Service, subject to the incident, backend eligibility confirmation, membership status, service availability, and these Terms.

The app may display membership status or Live Response eligibility. Membership status does not change the fundamental nature of the app’s digital tools.

5. WHAT A MEMBERSHIP PURCHASES

A paid membership purchases eligibility for the Live Response Service: access to trained human coordinators, External Response Center operations, incident review, attempted outreach, communication coordination, appropriate third-party escalation efforts, and coordinator-created incident documentation.

A membership does not purchase or unlock separate premium digital application functionality. Digital application tools are not the paid product. Membership fees support the external, human-operated service and the operational resources required to deliver it.

Membership may be obtained through the My Guardian Link website, an authorized organization, sponsor, employer, group administrator, referral arrangement, or another permitted sales channel. Available purchase methods may vary by jurisdiction and applicable app-store rules.

6. BACKEND ELIGIBILITY AND LIVE RESPONSE WORKFLOW

The Live Response Service is controlled by backend eligibility and assignment logic, not by the mere availability of app functionality. The general workflow is:

  • The user creates and transmits an alert through the mobile application;
  • The My Guardian Link backend receives the request and available incident data;
  • The backend checks whether the user and incident are eligible for the Live Response Service;
  • If eligible and technically received, the backend creates a Live Response assignment;
  • The External Response Center receives the assignment through systems separate from the consumer application; and
  • A trained Human Response Coordinator manages the assignment in accordance with available information, operational procedures, these Terms, and applicable law.

No Assignment Created

If the backend does not confirm eligibility, cannot receive or process the alert, or does not create a Live Response assignment, the External Response Center may not receive the incident. A digital alert, notification, or message is not proof that a coordinator assignment was created or that a coordinator received it.

7. IMPORTANT EMERGENCY SERVICE DISCLAIMER

My Guardian Link is not 911. My Guardian Link is not a police department, fire department, ambulance service, emergency medical provider, public safety answering point, government emergency service, security company, alarm company, or law enforcement agency.

The Services are intended to strengthen Human communication and coordination. They do not replace your responsibility to contact 911, local emergency services, law enforcement, medical providers, fire services, roadside providers, family members, caregivers, or other appropriate resources when needed.

If you can safely call or text 911 or local emergency services directly, you should do so. Do not wait for a My Guardian Link alert, coordinator, Trusted Contact, or third party before seeking direct emergency assistance.

My Guardian Link does not provide medical diagnosis, treatment, or professional medical advice. Information transmitted through the Services may assist communication but is not a substitute for qualified medical care.

8. NO GUARANTEE OF DELIVERY, RESPONSE, DISPATCH, OR OUTCOME

My Guardian Link does not guarantee that any alert, signal, message, phone call, push notification, email, location, map link, data packet, Trusted Contact notification, Live Response assignment, coordinator response, third-party communication, or escalation request will be delivered, received, reviewed, accepted, answered, acted upon, or completed.

My Guardian Link does not guarantee emergency dispatch, roadside dispatch, rescue, intervention, prevention of harm, recovery of property, apprehension of a person, medical outcome, response time, or any other specific result.

The Services are an additional communication and coordination resource. They are not guaranteed life-safety services.

9. SERVICE AVAILABILITY, CONNECTIVITY, AND LOCATION LIMITATIONS

The Services depend on systems and conditions that may be outside My Guardian Link’s control. Alerts and communications may be delayed, incomplete, inaccurate, interrupted, duplicated, misdirected, unavailable, or undelivered because of factors including:

  • Device condition, battery level, power-saving mode, storage, operating-system settings, app state, or software defects;
  • Disabled, restricted, or incorrectly configured location, notification, microphone, contacts, Bluetooth, background activity, or other permissions;
  • Cellular, data, Wi-Fi, internet, SMS, phone, carrier, roaming, or cloud-service limitations or outages;
  • Network congestion, terrain, weather, rural coverage, basements, elevators, tunnels, building materials, or local interference;
  • Unavailable, delayed, estimated, stale, or inaccurate GPS, Wi-Fi, cellular, map, or address data;
  • Third-party service failures, maintenance, cyber incidents, or interoperability problems; and
  • Public safety, assistance-provider, coordinator, or Trusted Contact availability and discretion.

Location Is Not Guaranteed

Coordinates, map pins, nearest addresses, directions, and location timestamps may be inaccurate or may not represent the user’s current physical position. You should provide location details directly whenever it is safe and possible.

10. USER RESPONSIBILITIES

You are responsible for:

  • Maintaining a compatible, charged, secure, and operational device;
  • Maintaining active cellular data service, phone service, or Wi-Fi access as needed;
  • Keeping your app and operating system updated;
  • Enabling and maintaining the permissions required for the features you use;
  • Keeping your name, phone number, email, address, profile, membership, Trusted Contacts, emergency contacts, and optional emergency information accurate and current;
  • Protecting your device, passwords, account credentials, and verification codes;
  • Using the Services only for legitimate, good-faith purposes;
  • Contacting 911 or another appropriate resource directly when safe and able; and
  • Understanding and accounting for the limitations of devices, networks, GPS, maps, messages, calls, Trusted Contacts, coordinators, and third-party services.

Effect of Failure

Failure to maintain your device, permissions, connectivity, account information, Trusted Contacts, or membership status may impair or prevent the Services from operating.

11. ACCOUNT REGISTRATION, ELIGIBILITY, AND ACCOUNT DELETION

To use certain Services, you must create an account and provide accurate information. You may not create an account using false information, another person’s identity, unauthorized contact information, or payment information you are not authorized to use.

You must promptly update information that changes. My Guardian Link is not responsible for failed or misdirected communications caused by inaccurate, incomplete, or outdated information.

You may request permanent account deletion through the Account Deletion function in the mobile application or through another method we make available. Account deletion is separate from membership cancellation. Deleting an account does not automatically create a refund, cancel amounts already due, or eliminate records that we are permitted or required to retain for legal, safety, fraud-prevention, dispute, or operational purposes.

12. TRUSTED CONTACTS, EMERGENCY CONTACTS, AND CAREGIVERS

The Services may allow you to add Trusted Contacts, emergency contacts, family members, caregivers, group members, sponsors, or other recipients. These persons may receive alerts, messages, phone calls, map links, location information, incident information, timestamps, or other communications related to your use of the Services.

Before adding a person, you must obtain that person’s permission to provide their information and to send communications through My Guardian Link. By adding a person, you represent that you are authorized to do so and will keep their information accurate and current.

My Guardian Link does not guarantee that any Trusted Contact or other recipient will receive, read, answer, respond to, or act upon a communication. Trusted Contacts are not employees or agents of My Guardian Link merely because they are designated in an account.

13. HUMAN RESPONSE COORDINATORS AND THE EXTERNAL RESPONSE CENTER

Human Response Coordinators are trained human operators who work outside the mobile application through an External Response Center. They use separate operational systems to receive and manage eligible Live Response assignments.

The External Response Center may be operated by My Guardian Link or by an independent third-party service provider under contract. Coordinators may rely on the information transmitted by the user, device, backend systems, Trusted Contacts, maps, and other sources. They are not required to independently verify every fact before acting.

Coordinator actions are based on the circumstances, available information, reasonable operational judgment, service availability, applicable procedures, and law. No coordinator can guarantee successful contact, escalation, dispatch, or outcome.

14. PUBLIC SAFETY AND THIRD-PARTY ESCALATION

When an Human Response Coordinator determines that escalation is appropriate and reasonably available, the coordinator may attempt to contact a public safety answering point, 911 center, law enforcement agency, fire department, emergency medical provider, roadside provider, caregiver, or other resource.

My Guardian Link does not control these agencies or providers. They may decline, delay, reprioritize, transfer, terminate, or otherwise handle a communication according to their own laws, policies, staffing, call volume, jurisdiction, available resources, classification rules, and discretion.

My Guardian Link does not guarantee that a third party will accept the information provided, identify the correct jurisdiction, locate the user, dispatch resources, reach the user, or achieve any particular result.

15. MEDICAL, ROADSIDE, AND OTHER ASSISTANCE LIMITATIONS

Any medical, roadside, caregiver, security, or other assistance referenced through the Services is provided by independent third parties unless expressly stated otherwise in a separate written agreement.

My Guardian Link does not diagnose medical conditions, prescribe treatment, provide transportation, tow vehicles, repair vehicles, furnish security personnel, or guarantee the qualifications, availability, conduct, price, response time, or outcome of any third-party provider.

You remain responsible for deciding whether to contact an appropriate provider directly and for any charges or terms imposed by that provider.

16. PROPER USE OF THE SERVICES

You may use the Services only for legitimate, good-faith safety, Human communication, reporting, roadside, caregiver, or approved practice purposes. Depending on available features, appropriate uses may include:

  • Real or reasonably perceived danger;
  • Threatening, suspicious, or unsafe situations;
  • Medical or personal distress;
  • Roadside incidents;
  • Situations in which you cannot safely speak;
  • Situations in which you want Trusted Contacts notified;
  • Good-faith “See Something, Say Something” reports;
  • Caregiver, family, or group-supported Human communication; and
  • Approved onboarding, training, demonstration, or practice activities.

17. PRACTICE, DEMONSTRATION, AND TEST ACTIVATIONS

Use only designated practice, demonstration, training, or test features for non-live testing. Any activation outside an approved practice function may be treated as a real incident and may cause communications, coordinator activity, or third-party escalation.

Do not test the Services by sending false information, contacting public safety unnecessarily, or repeatedly activating live functions. If you accidentally send a live alert, promptly communicate that the alert was accidental using the available cancellation, message, or call method, but understand that a cancellation may not stop communications already in progress.

18. MISUSE AND CONSEQUENCES

You may not use the Services for false alarms, pranks, harassment, stalking, threats, fraud, malicious reporting, impersonation, illegal activity, unauthorized testing, interference with public safety, or abuse of coordinators, Trusted Contacts, service providers, or public safety personnel.

Misuse may waste emergency resources, endanger others, and create civil or criminal consequences. To the maximum extent permitted by law, My Guardian Link may suspend or terminate an account, disable features, preserve records, disclose relevant information to appropriate authorities, cooperate with investigations, seek reimbursement for costs or losses, refuse future service, or take other lawful action.

You are responsible for misuse by you and for misuse by any person who accesses the Services through your device, account, credentials, or membership to the extent permitted by law.

19. MEMBERSHIPS, BILLING, AND RENEWAL

Certain users may obtain a paid membership, family plan, group plan, sponsor plan, referral arrangement, enterprise arrangement, or other paid access to the Live Response Service.

By purchasing a plan or providing payment information, you authorize My Guardian Link and its authorized payment processors to charge the disclosed fees, taxes, renewal charges, and other amounts. Unless otherwise disclosed, memberships may automatically renew until canceled.

The price, term, renewal date, included users, and other plan-specific information will be presented at checkout or in plan materials. You are responsible for canceling before renewal if you do not want the membership to continue.

My Guardian Link may suspend Live Response eligibility for failed payments, chargebacks, expired payment methods, suspected fraud, or payment disputes, subject to applicable law.

20. CANCELLATION AND REFUNDS

You may cancel a membership using the cancellation method provided in your account, payment portal, plan documents, or applicable marketplace.

For a user’s first paid membership purchased directly from My Guardian Link, the user may request a full refund within the first 30 days after purchase, unless a different written offer or applicable law provides greater rights. After 30 days, cancellation stops future renewal, but the membership remains active through the end of the paid term and no prorated refund is provided unless required by law.

If a paid membership ends or is refunded, the user may continue to use the My Guardian Link Free Plan if the Free Plan is then available and the user remains eligible.

Transactions processed by an app store, sponsor, employer, organization, referral group, or other third party may be subject to that party’s cancellation and refund rules. Where those rules control the transaction, refund requests must be directed to that party.

21. GROUP, FAMILY, SPONSOR, REFERRAL, AND ENTERPRISE ARRANGEMENTS

Additional terms may apply to family plans, group plans, sponsor groups, referral groups, employers, educational institutions, organizations, and enterprise customers. Such terms may address minimum group size, billing responsibility, invitations, onboarding, activation periods, administrators, sponsored access, referral compensation, user removal, replacement users, annual commitments, data visibility, and conversion to an individual or Free Plan.

A group owner, sponsor, employer, organization, or administrator may be able to view or manage limited account or eligibility information as described at enrollment and in the Privacy Policy. My Guardian Link is not responsible for disputes among group members, owners, sponsors, referral partners, employers, organizations, or administrators.

22. SMS, CALLS, EMAILS, PUSH NOTIFICATIONS, AND COMMUNICATION CONSENT

By creating an account, providing contact information, adding Trusted Contacts, joining a plan, or activating the Services, you consent to receive service-related communications from or through My Guardian Link, including SMS or text messages, phone calls, push notifications, emails, app messages, Trusted Contact alerts, account notices, billing notices, training messages, and Human operational communications.

Communications may be sent by My Guardian Link, the External Response Center, service providers, automated systems, Trusted Contacts, or authorized group administrators. Message and data rates may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages.

You may opt out of certain non-essential communications. Opting out of operational calls, messages, notifications, location sharing, or Human communications may limit or disable important functions. If a messaging program supports “STOP” or “HELP,” those commands apply only to that program and do not necessarily cancel your account or membership.

23. LOCATION DATA AND DEVICE PERMISSIONS

Certain Services use precise or approximate location, background location, GPS coordinates, map links, nearest-address information, directions, and location timestamps. By enabling location features or sending an alert, you authorize My Guardian Link and its service providers to collect, use, transmit, disclose, and retain location information as reasonably necessary to operate the Services, notify authorized recipients, support Live Response, document incidents, prevent misuse, and comply with law.

Location is not guaranteed to be available, current, or accurate. You may disable permissions in device settings, but doing so may impair or prevent location-dependent functions.

24. OPTIONAL PERSONAL, MEDICAL, AND EMERGENCY INFORMATION

You may choose to provide personal, medical, disability, caregiver, household, vehicle, emergency, or safety-related information. You are responsible for its accuracy, lawfulness, and appropriateness.

By providing this information, you authorize My Guardian Link and its service providers to use and disclose it as reasonably necessary to provide the Services, communicate with Trusted Contacts and coordinators, contact appropriate resources, document incidents, prevent misuse, and comply with law.

Do not submit information that you do not want shared with recipients who may reasonably need it in connection with an incident.

25. MINORS AND FAMILY-MANAGED ACCOUNTS

The Services are intended for users age 13 or older. A person under 13 may not create an account directly. A parent or legal guardian must create, manage, and consent to any profile or family-managed access for a child under 13, if such access is offered.

Users ages 13 through 17 may use the Services only with the consent and supervision of a parent or legal guardian, unless applicable law permits otherwise. Parents and guardians are responsible for account information, Trusted Contacts, appropriate-use instruction, supervision, fees, and misuse associated with a minor’s account.

My Guardian Link may suspend or terminate a minor account that is not properly authorized, supervised, or used.

26. PRIVACY

The My Guardian Link Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. It is incorporated into these Terms by reference.

The Privacy Policy may address account information, contact information, location, device data, Trusted Contacts, emergency contacts, alerts, incident records, optional medical or emergency information, payment data, communications, vendors, user rights, retention, and safeguards.

If these Terms and the Privacy Policy conflict regarding a privacy practice, the Privacy Policy controls for that privacy issue.

27. INCIDENT RECORDS AND DATA RETENTION

My Guardian Link and its service providers may create, maintain, review, preserve, use, and disclose records related to accounts and the Services, including account data, membership and payment records, alert activations, locations, notifications, messages, call information, coordinator notes, escalation records, timestamps, device and network data, misuse reports, and support records.

Records may be used for service delivery, quality assurance, training, fraud and misuse prevention, billing, compliance, insurance, dispute resolution, legal defense, law-enforcement cooperation, safety, and other lawful purposes.

Records may be retained after account deletion or membership termination when reasonably necessary or permitted by law.

28. SECURITY

My Guardian Link uses reasonable technical, administrative, and organizational safeguards designed to protect information. No app, device, website, network, transmission, or storage system is completely secure, and absolute security is not guaranteed.

You are responsible for securing your device, phone number, email account, credentials, operating system, and permissions. Notify My Guardian Link promptly if you believe an account, device, phone number, Trusted Contact list, or credential has been compromised.

29. ACCEPTABLE USE AND PROHIBITED CONDUCT

You may not:

  • Use the Services for unlawful, fraudulent, harmful, abusive, threatening, harassing, defamatory, obscene, or malicious purposes;
  • Submit false, misleading, incomplete, or deceptive information;
  • Trigger false, prank, malicious, or unauthorized alerts;
  • Impersonate another person or use another person’s account without permission;
  • Add a Trusted Contact or other recipient without authorization;
  • Use the Services to stalk, track, threaten, coerce, or control another person;
  • Interfere with public safety, the External Response Center, or another user;
  • Reverse engineer, disassemble, copy, modify, create derivative works from, or attempt to derive source code from the Services except where applicable law expressly permits;
  • Bypass security, access controls, service eligibility, or technical restrictions;
  • Access systems, data, accounts, or operational tools without authorization;
  • Upload or transmit malware, spyware, harmful code, or disruptive material; or
  • Abuse coordinators, support personnel, vendors, Trusted Contacts, or public safety personnel.

30. USER CONTENT AND INFORMATION RESPONSIBILITY

You are responsible for the messages, reports, information, images, recordings, notes, profile data, contact data, and other materials you submit or transmit through the Services (“User Content”). You represent that you have the rights and permissions necessary to provide the User Content and authorize its use as described in these Terms and the Privacy Policy.

You grant My Guardian Link and its service providers a non-exclusive, worldwide, royalty-free license to host, process, transmit, display, disclose, retain, reproduce, and otherwise use User Content solely as reasonably necessary to provide, operate, secure, improve, support, enforce, and document the Services; communicate with authorized recipients; investigate misuse; and comply with law.

31. THIRD-PARTY SERVICES

The Services may rely on third parties, including cellular carriers, internet providers, device manufacturers, operating-system providers, cloud hosts, mapping and location providers, payment processors, SMS and phone providers, app stores, analytics providers, External Response Centers, public safety resources, and assistance providers.

My Guardian Link does not control third-party services and is not responsible for their availability, accuracy, security, performance, delays, failures, terms, privacy practices, or conduct, except to the extent applicable law provides otherwise. Your use of third-party services may be subject to additional terms.

32. INTELLECTUAL PROPERTY AND GENERAL APP LICENSE

The My Guardian Link application, website, software, design, interfaces, text, graphics, trademarks, service marks, documentation, and other proprietary materials are owned by or licensed to Forward Move, LLC and are protected by intellectual-property laws.

Subject to these Terms, My Guardian Link grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the consumer mobile application on devices you own or control for your personal, lawful use of the Services. All rights not expressly granted are reserved.

You may not sell, rent, lease, sublicense, distribute, publicly display, commercially exploit, or create derivative works from the application or other proprietary materials except as expressly permitted in writing or required by applicable law.

33. APP STORES GENERALLY

If you obtain the application through Apple’s App Store, Google Play, or another marketplace, you must comply with the applicable marketplace terms. The marketplace is not responsible for the Live Response Service, Human communications, Trusted Contacts, emergency outcomes, customer support, or claims relating to My Guardian Link except to the extent required by its terms or applicable law.

Marketplace rules may govern application licensing, installation, updates, refunds for marketplace-processed transactions, and other matters. These Terms do not alter rights that cannot lawfully be limited.

34. CUSTOM END-USER LICENSE AGREEMENT FOR APPLE APP STORE USERS

If you download, install, access, or use the My Guardian Link mobile application through Apple’s App Store, the separate My Guardian Link Custom End-User License Agreement for the Apple App Store, as updated from time to time, is incorporated into and forms part of these Terms.

The Custom EULA governs the license to the Apple-distributed mobile application and Apple-specific rights and obligations. These Terms govern your account, use of the digital application tools, membership, billing, communications, and access to the Live Response Service.

If the Custom EULA conflicts with these Terms solely regarding the license to the Apple-distributed application or an Apple-specific requirement, the Custom EULA controls. These Terms control regarding My Guardian Link services and membership arrangements, subject to applicable law.

35. CHANGES TO THE SERVICES

My Guardian Link may add, modify, replace, suspend, restrict, or discontinue any part of the Services, including app tools, plans, pricing, partners, backend workflows, External Response Center procedures, coverage areas, and technical requirements.

Where required by law, we will provide notice of a material change. My Guardian Link is not liable for a lawful modification, suspension, restriction, discontinuation, or unavailability of the Services.

36. CHANGES TO THESE TERMS

My Guardian Link may update these Terms. Updated Terms may be posted in the app, on the website, in the account portal, or through another reasonable method, and the effective date will be revised.

Your continued use after updated Terms become effective constitutes acceptance to the extent permitted by law. If you do not agree, stop using the Services and cancel any membership. Material changes may require additional notice or affirmative acceptance.

37. SUSPENSION AND TERMINATION

To the maximum extent permitted by law, My Guardian Link may suspend, limit, or terminate your account, membership eligibility, Live Response eligibility, or access to any Service if we reasonably believe that you violated these Terms, misused the Services, failed to pay, created a security risk, harmed or threatened others, interfered with public safety or operations, violated law, or if suspension is required by a court, regulator, authority, public safety request, or legal obligation.

You may stop using the Services at any time. Membership cancellation and account deletion are governed by Sections 11 and 20. Termination does not eliminate obligations that by their nature should survive, including payment obligations, licenses necessary to retain records, disclaimers, liability limitations, indemnification, dispute provisions, and rights relating to misuse.

38. DISCLAIMERS OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS,” “AS AVAILABLE,” AND “WITH ALL FAULTS.” MY GUARDIAN LINK DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, RELIABILITY, UNINTERRUPTED OR ERROR-FREE OPERATION, EMERGENCY EFFECTIVENESS, RESPONSE EFFECTIVENESS, DISPATCH, RESCUE, PREVENTION OF HARM, AND ANY SPECIFIC OUTCOME.

MY GUARDIAN LINK DOES NOT WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE; THAT ALERTS, MESSAGES, CALLS, OR LOCATIONS WILL BE ACCURATE OR DELIVERED; THAT A LIVE RESPONSE ASSIGNMENT WILL BE CREATED; THAT A COORDINATOR, TRUSTED CONTACT, OR THIRD PARTY WILL RESPOND; THAT PUBLIC SAFETY WILL ACCEPT OR ACT UPON INFORMATION; OR THAT HARM WILL BE PREVENTED.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THE DISCLAIMERS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

39. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORWARD MOVE, LLC, MY GUARDIAN LINK, THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, VENDORS, LICENSORS, INSURERS, EXTERNAL RESPONSE CENTER PROVIDERS, HUMAN RESPONSE COORDINATORS, AND OTHER SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR LOST-PROFIT DAMAGES ARISING OUT OF OR RELATING TO THE SERVICES, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE FOREGOING PARTIES WILL NOT BE LIABLE FOR HARM OR LOSS CAUSED BY OR ASSOCIATED WITH DELAYED OR FAILED COMMUNICATIONS; INACCURATE OR UNAVAILABLE LOCATION; DEVICE, BATTERY, PERMISSION, NETWORK, CARRIER, GPS, MAP, CLOUD, SMS, PHONE, APP-STORE, OR THIRD-PARTY FAILURES; FAILURE TO CREATE OR RECEIVE A LIVE RESPONSE ASSIGNMENT; TRUSTED CONTACT FAILURE; PUBLIC SAFETY OR PROVIDER ACTS OR OMISSIONS; THIRD-PARTY CRIMINAL ACTS; USER MISUSE; OR A USER’S FAILURE TO CONTACT AN APPROPRIATE RESOURCE DIRECTLY WHEN SAFE AND ABLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MY GUARDIAN LINK’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO MY GUARDIAN LINK FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) FIFTY U.S. DOLLARS (US $50).

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED, INCLUDING RIGHTS AVAILABLE UNDER APPLICABLE CONSUMER-PROTECTION LAW.

40. INDEMNIFICATION

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Forward Move, LLC, My Guardian Link, their affiliates, officers, directors, employees, contractors, vendors, licensors, insurers, External Response Center providers, Human Response Coordinators, and service providers from claims, losses, liabilities, damages, judgments, settlements, penalties, fines, costs, and reasonable attorneys’ fees arising out of or relating to:

  • Your use or misuse of the Services;
  • A false, prank, malicious, unauthorized, or improper activation;
  • User Content or information you submit;
  • Your failure to maintain accurate account, contact, emergency, device, permission, connectivity, or membership information;
  • Your violation of these Terms, law, or another person’s rights;
  • Your addition of a Trusted Contact or recipient without authorization;
  • Your group, sponsor, referral, employer, or administrator actions; or
  • A third-party claim connected to your unlawful or improper use of the Services.

Limitations

This section does not require indemnification to the extent prohibited by applicable law or to the extent a claim results from a party’s own conduct for which indemnification cannot lawfully be imposed.

41. FORCE MAJEURE

My Guardian Link is not responsible for a delay, failure, interruption, or inability to perform caused by events beyond its reasonable control, including carrier or internet failures, cloud or communications outages, GPS or mapping failures, app-store outages, power failures, cyberattacks, natural disasters, severe weather, fire, flood, earthquake, war, terrorism, civil unrest, public emergency, labor dispute, government action, public safety system overload, pandemic, failure of third-party providers, or other extraordinary conditions.

42. DISPUTE RESOLUTION, GOVERNING LAW, AND VENUE

Before filing a formal claim, you and My Guardian Link agree to make a good-faith effort to resolve the dispute informally. A written notice should describe the issue, relevant facts, and requested resolution and should be sent to the contact information in Section 46.

Except where applicable consumer law requires otherwise, these Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles. Any court proceeding arising out of or relating to these Terms or the Services must be brought in a state or federal court located in Wisconsin, and the parties consent to that jurisdiction and venue.

Nothing in this section prevents either party from seeking appropriate emergency or injunctive relief or using a small-claims court with jurisdiction. These Terms do not contain a mandatory arbitration or class-action waiver.

43. ELECTRONIC ACCEPTANCE AND NOTICES

You agree that these Terms may be accepted electronically, including by clicking “I Agree,” checking a box, creating an account, downloading or using the app, purchasing or using a plan, activating a feature, or continuing to use the Services after notice of an update. Electronic acceptance has the same legal effect as a physical signature to the extent permitted by law.

You consent to receive agreements, disclosures, notices, billing information, renewal notices, cancellation notices, and other communications electronically through email, SMS, app notification, website posting, or the account portal.

44. ENTIRE AGREEMENT AND ORDER OF PRECEDENCE

These Terms, the Privacy Policy, plan-specific terms, checkout disclosures, group or sponsor terms, communication terms, and any additional terms presented and accepted by you constitute the entire agreement regarding your consumer use of the Services.

If a specific, accepted plan or checkout term conflicts with these Terms, the more specific term controls for that subject. If Apple-specific terms in Section 34 conflict with another provision solely as applied to the Apple-distributed Licensed Application, Section 34 controls to the extent required by Apple’s applicable minimum EULA terms.

45. SEVERABILITY, NO WAIVER, AND ASSIGNMENT

If any provision is found invalid, unlawful, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable or, if modification is not possible, severed. The remaining provisions remain in effect.

A failure to enforce a provision is not a waiver of the right to enforce it later.

You may not assign or transfer your rights or obligations under these Terms without prior written consent. My Guardian Link may assign or transfer these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, corporate transaction, or operation of law.

USER ACKNOWLEDGMENT

By creating an account, using the Services, or electronically accepting these Terms, I acknowledge and agree that:

  1. My Guardian Link is not 911 and does not replace calling or texting 911 or local emergency services.
  2. If I can safely contact 911 or another appropriate resource directly, I should do so.
  3. The mobile application provides digital communication and safety tools; the Live Response Service is a separate, human-operated service performed through an External Response Center.
  4. A paid membership purchases eligibility for trained human coordinator and External Response Center services, not separate premium digital app functionality.
  5. A digital alert does not guarantee that a Live Response assignment will be created, received, or handled.
  6. My Guardian Link does not guarantee alert delivery, coordinator contact, third-party escalation, dispatch, rescue, prevention of harm, or any specific outcome.
  7. The Services depend on my device, battery, settings, permissions, connectivity, location accuracy, third-party systems, and the availability and discretion of recipients and public safety resources.
  8. I am responsible for maintaining accurate account, Trusted Contact, emergency, device, permission, and payment information and for using the Services lawfully and in good faith.
  9. I authorize the collection, use, transmission, disclosure, and retention of information reasonably necessary to provide the Services as described in these Terms and the Privacy Policy.
  10. I have read and agree to these Terms and the Privacy Policy.

I understand that these Terms are legally binding and that I should retain a copy for my records.
